台湾环境公民诉讼制度述评

台湾地区1999年首次规定了环境公民诉讼制度.该制度的建立适应了台湾环境运动向法制化发展,加强了环境法规的执法力度,具有积极的意义.经过近十年的运行,民众对于环境公民诉讼制度逐渐了解,团体诉讼定位不断明确,司法界对法律的适用也变得日臻成熟.但是,对于正处于发展阶段的环境公民诉讼制度,仍然面对立法和实务上的挑战.如何从法律上定位环保团体的诉讼功能并赋予其当事人资格,是台湾法律界亟待解决的问题.
