| 摘 要： | 我国新《刑事诉讼法》关于口供制度的新规定有进步性,但还存在不足,要通过建立非法口供排除规则的确认标准、明确非法口供的排除程序、确立自白任意性规则、建立沉默权规则、完善看守所管理体制等路径,完善我国口供制度设计。

| Abstract: | This paper based on the analysis of current confession system in the new criminal procedure law shows its progressiveness as well as its defects and puts forwards several ways to perfect the current confession system,such as set criteria and procedures in excluding illegal confession,establishing arbitrary principle of confession and principle of right of silence,perfecting detention center management system,etc. |
