中国行政法的传统之根与未来之路

Tradition and Future of Chinese Law of Administration

TAs a research subject, Chinese law of administration originated in the end of Qing Dynasty. However, as a legal system, Chinese law of administration has a history as long as the Chinese legal system. Its humanism and cultural conceptions have influenced the development of present law of administration, which constitutes the root of Chinese law of administration and determines its results. Experts of Chinese law of administration should pay attention to the history. Chinese law of administration originated in China and its development depends on the efforts of Chinese scholars. Future roads can be paved only after we surpass the mechanical transplant period and grasp the traditional root of Chinese administrative law. It is Chinese scholars' responsibility to seek a feasible road between tradition and reality.
