| 摘 要： | 刑事诉讼的价值仅从哲学认识论的视角看易过于着重强调刑事诉讼的外在价值,而从哲学伦理学的视角看易过于青睐刑事诉讼的内在价值,只有把两者结合起来,才能完整地理解刑事诉讼的应有价值。同时,不同刑事诉讼模式下的诉讼价值又形态各异。

| Abstract: | It is easy to over-emphasis the external value of the criminal procedure only from the perspective of philosophical epistemology,or too easy to favor its intrinsic value only from a philosophical perspective of ethics.So in order to understand the criminal procedure completely,both of the two aspects should be considered.Meanwhile,the criminal procedural value shows different characteristics in defferent litigation modes. |
