| 摘 要： | 本文对《行政强制法(草案)》(三审稿)中存在的三项主要争议从实践层面进行了系统探讨。作者认为,行政强制设定权应配置给法律、行政法规和地方性法规,但在条文表述上应修改得更加严谨;行政强制实施体制原则上应实现裁执分离,行政机关作出行政强制决定后,应申请人民法院审查并裁定,但一律由行政机关负责执行;行政强制基本原则应包括四项:行政强制法定原则、比例原则、教育与强制相结合原则和正当法律程序原则。
