被告人口供证据规则之完善

我国刑事诉讼法中有关被告人口供的规定过于抽象,操作性差,缺乏完备的证据规则,难以保障口供发挥应有的作用。因此,必须建立有关证据能力方面的任意性和非法证据排除规则以及有关证明力方面的补强规则,完善我国被告人口供证据规则。

The Perfection of Evidence Rules for the Defendant's Confession

The regulation of the defendant's confession in the code of criminal procedure is too abstract, less operation, and lack of complete evidence rule, so it is hard to ensure the function of confession. Therefore, we must construct the arbitrary rule of evidence capability , the exemption rule of unlawful evidence and the reinforcement rule of provability, and perfect the rule of defendant's confession in our country.
