行政伦理建设的法治化路径初探

行政伦理是一种规范伦理,与主要追求个人道德品性的完善的美德伦理不同,它更强调以法律法规约束公职人员的作为。行政伦理的这种属性决定了行政伦理建设必须走法治化的道路。本文就是首先明确行政伦理的本质属性,分析了将其错误定位为美德伦理的逻辑矛盾和脆弱性,并借鉴西方国家的有关经验,就我国行政伦理法治化提出了初步设想。

On the Ways to Build Administrative Ethics by Law

Administrative ethics is the ethics of standardization. It differs from moral ethics for the perfection of personal morality, and puts emphasis on restriction of public servants' behaviors by law and regulation. This attribute of administrative ethics determines the evitable way to build administrative ethics. This article, first of all, confirms this essential attribute, analyses logical contradictions and frailness of the wrong location of it as moral ethics, and using the relevant Western experience for reference, puts forward the primary ideas of China's based -on -law administrative ethics.
