| 摘 要： | 在我国,保护证人的主管机关以各级公安机关为宜。在现阶段,获得保护的证人必须是特定刑事案件的主要或关键的控方证人并且确实处于危险状态;建议设置警卫保护、迁移保护与整容保护等证人保护措施并分别规定其适用范围;不能忽视对“污点证人”的保护。建议国家尽快以法律的形式确立这一制度。

| Abstract: | In China,the major administrative section in charge of witness protection is expected to be all levels of public security organs.At present,the protected witnesses should be the major ones in specific criminal cases and those really in danger.It is advisable that this kind of witness should be protected through safekeeping,transference and plastic surgery,but different ways of protection should be applied to different cases.Besides,"guilty witness" protection should not be neglected.It is suggested that this system be set up in legal form. |
