民法典编纂人格权的体例安排综述

民法典总则的编纂已经如火如荼地展开,而学界关于民法典应当展现的具体形态还存在诸多分歧。从上世纪九十年代开始,我国民法学者对于民法典应当如何编纂进行了深入持久的讨论,但到目前为止,关于人格权法在法典中的位置和内容的编排远没有达成一致。应当确定人格权在民法典中的应有地位和具体内容安排,以加速民法典编纂的进程。

Review on the Style Arrangement of the Compilation of Personality Right in Civil Code

The compilation of the general principles of civil code has been in full swing, but about the concrete form of the civil code, there still exists many differences in academic circles. From the beginning of the nineties of the last century, scholars of civil law in our country launched a deep and protracted discussions about how the civil code should be, but so far, about the law of personality right in the code for the location and content arrangement far failed to reach an agreement. The proper position and specific contents of the right of personality in the civil code should be determined, so as to accelerate the process of codification of the civil code.
