| 摘 要： | 期待可能性理论是指根据具体情况,有可能期待行为人不实施违法行为而实施其他适法行为。期待可能性理论的存在根据有其合理性和科学性;缺乏期待可能性的行为应减免处罚;通过对主观罪过的影响进而影响刑事责任的有无或轻重。期待可能性理论的合理因素可以为我国刑法所吸收和借鉴。

| Abstract: | The theory of the anticipated likelihood means that the behaviorist can be anticipated to do legal things according to the circumstances. The anticipated likelihoods being is rational and scientific; The punishments inflicted on the action that is short of the anticipated likelihood should be reduced; The anticipated likelihood has an effect on criminal responsibility through influencing subjective faults. The rationality of the anticipated likelihood can be drawn. |
