| 摘 要： | 警察行政调查即警察机关出于治安行政管理的目的,对治安信息进行收集和处理的活动。行政权力的自我制约在独立性、公正性等方面有法理上的先天不足,更何况现在对警察行政调查的认识和立法、司法制约都极其贫乏,所以立足实际,以行政相对方权利制约警察行政调查权就尤其凸现出了其必要性。

| Abstract: | The police administrative investigation is to collect and deal with the information of public order for the purpose of the administrative management of public order.There are some shortcomings in the self-controlling of the administrative power,for example,it is not completely independent and justified.People don't fully understand the police administrative investigation,it lacks of legislation stipulation and it has no judicial restriction.Therefore,it is necessary to limit police's power of administrative investigation by using administrative other party's right. |
