试论服刑人员婚姻权利的实现

执法部门对服刑人员结婚申请处理结果的不同,折射出我国相关法律制度的不健全和认 识的模糊。服刑人员的婚姻权因丧失人身自由而没有独立性、自主性,具有极强的依赖性,处于被 暂时限制状态。建议制定法律,明确服刑人员的婚姻权,规范执法机关的执法行为,创造条件,保障 服刑人员婚姻权的实现,促进对服刑人员的改造。

On Realization of Prisoners' Right of Marriage

How the legal enforcement departments deal with marriage applicants of a prisoner indicate imperfectness and ambiguity of our legal system,for the consequences will quite different.My article theoretically points out that prisoners have their own marriage right ,which now is not independent and self - determined but dependent and temporarily restricted due to serving a term in prison.I suggest to make a law to make sure of prisoners' marriage right and normalize law departments,thus we can develop an environment to secure their marriage right and help them become a new man.
