| 摘 要： | 我国刑法对传播淫秽物品牟利罪法定刑的规定,远高于传播淫秽物品罪法定刑的规定。这种规定的合理性值得怀疑。而且,传播淫秽物品犯罪主要是一种针对道德的犯罪,但刑法对行为人人身自由的处罚最高可达无期徒刑,这显然也值得思考。

| Abstract: | In Chinese criminal law,the legal penalty of crime of spreading obscene articles for the purpose of profit is higher unreasonably than that of crime of spreading obscene articles.Offence of spreading obscene articles is mainly a crime on morality,but the highest penalty can be life imprisonment.Obviously this legislation is not scientific. |
