| 摘 要： | 转化型抢劫罪在司法实践中属难点,由于涉及到转化前犯罪行为和转化后犯罪行为以及转化条件,因而增加了实践中把握这种类型犯罪的难度。转化型抢劫罪适用的前提条件是行为人必须是先“犯盗窃、诈骗、抢夺罪,”而不是先犯其他犯罪;在认定转化型抢劫罪中“当场”的含义时,应把握三个原则。文章对司法实践中常出现的难点问题进行了探讨,其观点具有一定的借鉴意义。

| Abstract: | Invert robbery crime is diffcult point in legal practice.Because involving behind invert crime action and after invert crime action,so holding this kind crime is more difficult.The premise of this crime application is crime involving theft,bild and snatch,not other crime.We should hold three principles in confirming the meanings of on the spot.The paper probes the difficult points in judicial practice.The views bave some meaning for use. |
