公众参与:案例规范生成的民主化进路

民主化是我国案例规范生成模式的追求目标之一,司法运行中却一直被空置。案例规范兼具司法和政治双重属性,这决定了公众参与的模式汲取公众意见的同时能够保持相对和必要的独立,其正当性和必要性能够得以证成。当务之急在于建立有利于公众推荐案例的体制、程序,推动案例信息公开、规范指导性案例推荐流程,并建立相应的案例筛选、审查机制和司法回应机制,使公众和司法在沟通中实现良性互动,并由此为我国案例规范提供民主化的生成进路。

Public Participation: the Democratic Path of Case Specification

Democratization, as one of the goals of case specification generation mode, isn＇ t practically implemented in judicial practice. Case specification has judicial and political attributes, which means the public participation mode can be kept relatively independent while drawing public opinions and its legitimacy and necessity can be proved. Now, the institution and procedure that facilitate the public to recommend cases should be buih to promote information disclosure and standardize the guiding process of cases recommendation. Case filtering, examining and judicial response mechanis,ns shouhl also he buih to achieve positive communication between the public and the judicial organizations. Thus, demncratization patterning can be provided for case specification of China.
