| 摘 要： | 我国刑事鉴定制度存在以下不足 :1、法律对刑事鉴定机构鉴定权的授予、人才条件、设备要求、资信程度无统一规定 ;2、鉴定人的资格认证没有法定标准 ;3、法律对鉴定人的权利义务规定不够完善 ;4、鉴定结论的效力缺乏法律依据。改进建议 :1、进一步规范现场勘查工作 ;2、规范鉴定机关工作 ;3、加强从业人员资格认证管理工作 ;4、明确鉴定机构权力范围和鉴定结论的效力

| Abstract: | Some shortcomings in the criminal identification system of our nation are as followed:no unified regulations on the criminal identification authority, staffs, equipment and qualification; no legal standard on the qualification attestation of identifiers; no perfect regulations on rights and duties of identifiers; little legal basis on the force of identification conclusion. The following is suggestion to improve the condition:to standardize on-the-spot reconnaissance; to standardize identification organs; to improve the qualification attestation of identifiers; to make clear the authority scope of identification organization and the force of identification conclusion. |
