摘要：	一、引言植物新品種是植物育種者智力勞動的結晶,因而與發明創造、作品等智力創造性成果一樣屬於知識產權保護的客體。建立保護植物新品種的知識產權保護制度,成爲各國以及國際公約鼓勵對植物新品種的研究,保護植物育種者的合法權益,促進植物新品種的創造和利用的重要法律制度。
