| 摘 要： | 哈特以“更多的社会学”倾向的语义分析学为自己的法律实证主义容纳了更多的思想从而体现出博大的理论体系。哈特的法律规则说一方面以规则为核心为分析实证法学张目，另一方面其阐述的基本理论问题所承负的社会学内容已大大流溢于规则之外。在哈特理论以规则为中心的语汇与语汇背后的社会学内容之间存在的紧张关系，表明其法律规则说具有一定的局限性。

| Abstract: | Hart's legal rule theory has a bigger theoretical system,which contains broad matters of sociology by its semantic analysis.Hart's legal rule theory,on the one hand,argues for the positive jurisprudence,on the other hand,has more sociology contains beyond legal rules.Obviously there is a strained relation between the words about rules of Hart's theory and its sociology connotation,which shows the limitations of Hart's legal rule theory. |
