| 摘 要： | 在诉讼实践中,当事人缺席有三种不同的情形,而现行《民事诉讼法》只对其中的一种情形做了规定,凸显出立法的先天不足。作者认为,应当根据缺席的不同情形采取不同的方式处理,而不应一律做出缺席判决。在修订《民事诉讼法》时应增设预防和救济机制和专门的缺席审判程序来处理不同诉讼主体在不同的诉讼阶段缺席的情况,以完善我国缺席审判制度。
