热污染损害赔偿之我见--从司法实例谈起

On Compensation For Damages of Thermal Pollution--Query About the Grounds and Results of Judgment For Cases of Thermal Pollution

This article queries about the grounds and results of judgment for a case of "thermal pollution". In the case, the court holds that there is no related provision about thermal pollution in our country, and they have no legal basis for determining its nature as a case of "thermal pollution", but the defendant in deed caused damage to the plaintiff, so according to the rule of adjacent relation and principle of fairness in civil law, the plaintiff should be given certain compensation. The author thinks that no "blank" in legislation about thermal pollution exists in our country, but only the relevant law is not perfect. There is legal basis for determining the nature of this case as an infringement case of thermal pollution damage.
