| 摘 要： | “首要标准”是当下行刑领域的时新话题。监狱工作贯彻落实“首要标准”,必须辩证地看待监狱行刑理念与行刑技术的关系、监管工作法律效益与社会效益的关系、监狱工作实然与应然的关系、监狱行刑功利主义与人道主义的关系。澄清这些令人困惑的问题,应是监狱工作实现历史性超越的前提。

| Abstract: | The primary standard is a new topic in the current execution field.When the prison implements the primary standards,we should view dialectically the relationship between prison execution concept and execution technology,the relationship between the legal benefits of supervision and social benefits of the supervision in prison management work,the relationship between prison execution utilitarian and humanitarian,and so on.The clarifications of these puzzled prob-lems are the precondition to realize the historic transcendence. |
