| 摘 要： | 过失危险行为犯罪化在立法上已经为许多国家所采纳,但在刑法理论上,过失危险行为是否应当犯罪化,中外刑法学界仍有分歧。就过失危险犯与传统过失理论的关系,过失危险犯与信赖原则与允许的危险理论的关系以及信赖原则与允许的危险理论适用条件,过失危险犯与社会生产力发展这三个角度着眼,过失危险行为应当犯罪化。
