台湾日治时期刑事侦查与犯罪控制体系研究

1895年到1945年的台湾处于日本统治之下,在此期间,改行与传统中华法系不同的西方司法制度。除了日本法的移植以外,还保留了传统中国的刑事对策,如保甲连坐制度、鞭笞刑等,对于原住民族地区采取某些程序便宜政策,形成了"台湾特色"的侦查与犯罪控制体系。该体系由四个部分组成,即一般司法模式、军事侦查体制、旧有犯罪控制体制、特别法调整下的刑事对策。

Analysis about Criminal Investigation and Crime Control System in Taiwan during the Japanese Occupation

In 1895 to 1945,Taiwan was under Japanese rule,it diverted from the traditional Chinese legal systems to the Western judicial system during this period. In addition to transplantation of Japanese law,the traditional Chinese criminal countermeasures was retained, such as Bao Jia system, whipping pun- ishment. Aboriginal areas adopted some convenient program policy,and formed＂the characteristics of Tai- wan＇in the investigation and crime control system which consists of four parts,namely the general mode of judicial,military reconnaissance system, the old criminal control system and the criminal measures under the adjustment of special law.
