| 摘 要： | 强化教育法哲学的研究对于教育法学学科建设非常必要。新学科是在原有学科内容的基础上产生的,教育法哲学视阈集合了原有学科内容和方法,形成了新的学科内容和方法。教育法哲学中的哲学导向包括人的发展的无限性、抽象性和目的性;教育法哲学中的法学定位包括人的发展的规范性、有限性、交互性和利益性;教育法哲学中的教育学定位包括人的发展的全面性、阶段性、专门性。教育法哲学应包括哲学的、法学的、教育学的基本概念与范畴。
