略论我国刑事辨认的完善

刑事辨认作为一项重要的侦查措施，具有引导侦查取证方向、物证书证的鉴真、证据关联性的确认以及作为证据链节形成证据链等四个方面的作用。虽然学界关于辨认的基本概念与规则已达成一致，但无论从立法还是在实践上，我国的刑事辨认制度都还存在各种各样的问题，导致辨认屡屡出现在错案之中，体现了辨认的局限。因此。要采取将刑事辨认纳入刑事诉讼法、制定和完善辨认规则以及从过程和结果两个维度加强对辨认的控制等四个方面的措施，以其规范辨认行为，提高辨认的准确率。
