| 摘 要： | 因我国刑事公诉审查程序流于形式带来诸多弊端,对其改革已经成为必要。但如何改革仍未形成定论。要不要及如何设立公诉审查程序,成为我国公诉审查程序改革的两大焦点问题。公诉审查程序对于制约滥行公诉、保障被告人人权、促进审判公正具有不可或缺的价值。应当反思我国公诉审查程序的理论与实践,借鉴法治国家的经验,科学合理地构建我国的刑事公诉审查程序,为我国刑事诉讼法的再修改提供参考。
