| 摘 要： | 与传统物权冲突法相比,当代物权冲突法出现了一些新的发展,物之所在地法虽然在涉外物权法律适用规则中仍然居于主导地位,但涉外物权领域出现了一些新的法律适用规则。当代物权冲突法的这些新发展有着深刻的经济、社会与法律方面的原因,中国涉外物权法律适用规则应当结合当代物权冲突法的新发展作出相应的修改与完善。

| Abstract: | Compared with the traditional real right conflict law,there are many new development in contemporary real right conflict law.Although lex situs is the main provision,there are many new provisions in foreign real right application law field.There are economic,social and legal reasons in these new development.The foreign real right application law provision of China should be modified and perfected according to the new development of contemporary real right conflict law. |
