| 摘 要： | 对预告登记性质的探讨涉及两个层面，一是预告登记本身的性质即形式意义上的性质，二是经预告登记后权利的性质即实质意义上的性质．经预告登记后产生的法律上之力与预告登记所担保的债权请求权的效力不同，它是一项形成权。

| Abstract: | The discussion about the properties of the advanced notice registration involves two planes,one is the nature of the advanced notice registration,which is the nature of form,the other is the nature of the right after the advanced notice registration,namely the nature of essence.After legally registered,the right is different from the claiming right of creditor's rights and it is a kind of right of formation. |
