| 摘 要： | 本文通过分析"重庆烟灰缸坠楼伤人"一案,对加害人不明的侵权责任法律适用中存在的几点争议问题提出了自己的看法,并就解决加害人不明的侵权责任的途径及法理基础作了初步的探讨。
