| 摘 要： | 公序良俗是现代民法一项重要的基本原则 ,在现代市场经济条件下 ,它弥补了现行法律规定的不足 ,在确保国家社会利益、一般道德秩序 ,以及协调各种利益冲突、维护社会正义等方面发挥极重要的机能 ,同时也是赋予司法裁量权的依据。本文对公序良俗原则的基本理论、功能、适用等问题进行了系统的论述。

| Abstract: | Public order and good customs is one of the most important basic principles of modern civil law, which protects the public interests and morality of the society in market economy. It plays a significant role in balancing the interest relationship between litigants and society, and may be the basis of discretion vested in judges. The article makes a systematic discussion on the fundamental theory, function and application of the principle. |
