在现代市场经济条件下,商法的地位值得我们去深入研究,在世界经济一体化、全球化趋势中,如何去发展商法、如何构建现代商法是我们必须去探讨的.考察商法历史的演变、商法理念以及商法产生和发展的社会经济条件的变化,可知现代商法是一个独立的法律部门,具有自己鲜明的个性和品质,现代商法的基本体系依然需要保持着传统模式,但在新的社会经济条件下,商法的理念正在发生一定的变化,如何实现商法的现代化正在我们面临的主要课题.

The Independency of the Modern Commercial Law

Under the modern market economy conditions,the position of the commercial law is worth lucubrating,among the world economic integration and globalization trend,we must discuss how to develop commercial law and how to construct modern commercial law.Through the analyses on the evolvement of the history of commercial law,the commercial law ideas,and the changes of the social and economic conditions that the commercial law came into being and developed.This paper thinks that the modern commercial law is an independent law department,which has its own distinct personality and character.The basic system of the modern commercial law still needs to keep the traditional mode.But under the new social economic conditions,the ideas of commercial law are changing.A main subject that we are faced with is how to realize the modernization of commercial law.
