| 摘 要： | 卧底侦查是侦破有组织犯罪、团伙犯罪等案件的有效手段，但其衍生的相关法律问题很少有人关注．我国目前司法实践中在没有明确的法律依据及司法行政节制之下，为了司法实务的需要把卧底侦查作为权宜之计存在诸多弊端．法治社会卧底侦查需要有坚实的社会基础并有相应的法律依据。

| Abstract: | It is an effective means that undercover investigation of the detection of organized crime,gangs and other criminal cases.But people pay little attention to the legal issues.The article gives a more in-depth analysis about the undercover investigation of the related concept of and the undercover investigation society based on law of the situation.The article also discusses the issues including the authorization of undercover investigative organs,the implementation of principal,the target,and the implementation procedures and undercover officers with security responsibilities,with a view to giving some help to justice theory and practice of building. |
