我国政府绩效管理和评估法制化问题研究

摘    要:我国各级政府绩效管理和评估的实践,对政府绩效观念的强化、服务理念的提升、管理效率的提高等都起着巨大的推进作用.但是,政府绩效管理和评估在法制建设中并没有得到清晰、完整的规定.政府绩效管理和评估缺乏专门立法保障,监督机制不健全,事后救济制度不完善.这不仅导致政府权力滥用,给公众利益造成损害,也不利于政府威信的树立.我国要避免政府绩效管理和评估出现的各种问题,强化绩效管理的执行力度,就必须顺应世界各国政府绩效管理立法的趋势,加快绩效管理和评估法制化的进程.

Abstract:During the past decades, the performance management and assessment in China's governments has great influence on the sense of government performance, the concept of service and the efficiency of management. However, the legislation of the performance management and assessment has not been prepared adequately to be on the way. Nowadays, government performance management and assessment in China do not ruled by special laws and supervisory systems and the relief system after event are not available, which would result in misusing the power, bringing harm to the public benefit and even ruining the authority of government. In order to avoid those problems and strengthen the implement of government performance management and assessment, their legalization process in China should be expedited according to the international legislation trend.
