| 摘 要： | 德、日原因自由行为理论历史悠久、理论丰富。从德、日原因自由行为理论考察出发,分别对德国的＂例外模式＂理论、＂行为构成模式＂理论,日本的＂间接正犯类似说＂、＂最终意思决定说＂、＂相当因果关系说＂进行了述评,并建言应对传统责任原则进行相对合理的修正。
