| 摘 要： | 近年来,由酒驾引起的道路交通事故频频发生,严重危及人们的生命财产安全及社会公共安全。《刑法修正案(八)》的出台将醉酒驾驶作为一种犯罪行为列入我国刑法,为此理论界和实务界争论不休。本文将从醉驾的概念、犯罪类型、罪过形式及其法律适用方面探讨刑法意义下的醉驾性质。
