沈阳市社区矫正实施问题实证研究

社区矫正是当今世界各国刑罚制度发展的趋势,我国社区矫正制度从2003年开始由理论走向实践。沈阳市从2010年11月开始,决定采取试点先行、逐步推开的策略,分三步在全市开展社区矫正工作。本文从社区矫正的基本属性及理念入手,在剖析沈阳市社区矫正实施问题的基础上,力求对沈阳市社区矫正制度的建立和完善有所突破,为立法提供参考,并期望对司法实践有所服务,提高行刑社会化在行刑体制中的作用,为构建社会主义和谐社会,预防犯罪特别是重新犯罪尽我们的绵薄之力。

Empirical research on implementation of community correction in Shenyang City

Community correction is the developing trend of the penal system all over the world today.Community correction system in China has stepped from theory to practice since 2003.Shenyang City decided to take the strategy of pilot first and gradually pushed,and carried out the Community Correction in three steps in the city in November 2010.The paper started from the basic properties and concepts of community correction,based on the analysis of implementation issues of community correction in Shenyang City,to strive to make a breakthrough in establishing and perfecting the community correction system in Shenyang City,provide a reference for the legislation,and look forward to serve the judicial practice and improve the role of execution socialization in the execution system to contribute for building a harmonious socialist society,preventing the crimes,especially the recidivism.
