我国非法证据排除程序的完善

对于非法证据排除程序的完善首先是对司法人员、执法人员法律意识的培养，增强其人权、程序、法治意识，只有在打下坚实法律意识的基础上才能保证该程序的顺利实施。完善非法证据排除程序的第二个方面措施是对其自身内容的完善。通过前文对非法证据排除程序自身规定性内容的分析，本文最后提出应从非法证据的法律规定、非法证据证明标准的重新界定、赋予检察机关排除非法证据的裁判主体地位、延伸证人、被害人申请排除非法证据的提出时限等四个大方面予以完善。除此之外本文还提出应对有关制度加以完善。对于外部制度的完善，本文提出应主要从两个方面入手，即完善及保障律师在刑事诉讼中的权利，以及强化驻所检察官的监督职责等。

The improvement of the procedure of excluding illegal evidence is first the training of the legal awareness of the judicial officers and the law enforcement officers to enhance their human rights,procedures,and legal awareness.Only lay a solid legal awareness can ensure the smooth implementation of the program.The second aspect of the measures is to improve the perfection of the procedure of excluding illegal evidence.Through the analysis of the procedure of excluding illegal evidence,the article proposed to perfect it from the legal regulation of the illegal evidence,the redefined standard of illegal evidence,vesting procuratorial organs magistrates’ dominant position with the exclusion of illegal evidence,and the extension of the proposed time limits for the witnesses and victims to apply for the exclusion of illegal evidence.In addition,the article also proposed to improve the related system.For the improvement of the external system,the article proposed to start mainly from two aspects,those were to improve and protect the right to counsel in criminal proceedings and to strengthen in the prosecutor’s oversight responsibilities.
