| 摘 要： | 现代主要法治国家，普遍以公正和高效为价值目标，调整本国侦控构造。大陆法系国家，警察机关成为实际的侦查主要力量．而检察机关虽然享有全部侦查权，但其侦查权逐渐弱化，成为形式上的侦查权主体；英美法系国家，检察机关逐渐强化对侦查程序的影响，检警关系逐渐紧密化。我国侦控构造无论在公正还是在效率上都存在问题，应当以公正和高效为价值目标，强化检察机关的侦查监督，确立检察机关的侦查指挥权。

| Abstract: | In modem times nomocracy countries,put justice and effectiveness as valuable aim,adjust our country＇s detective structure.In civil law countries,police department becomes the main force of detective,although prosecution has the whole right of investigation,it＇s right fade out gradually. Becomes the main force of investigation formally;in Common Law countries,prosecution strengthen the effect of investigation procedure.The relationship are becoming tightness between prosecution and police department gradually.Our country＇s investigation structure exists problems not only in justice but also in effctiveness,we should put justice and effectiveness as valuable aim, strengthen investigation intendance of prosecution,establish the investigation command of prosecution. |
