论混合担保中的债权人放弃部分担保的问题

混合担保是在同一债权上设置不同形式的担保。在混合担保中,各担保人的责任划分不同。债务人提供的物保优先,第三人提供的物的担保和人的担保地位平等。我国现行立法对于混合担保中各担保人责任划分不明确,给债权人放弃部分担保后的责任认定带来不便。当债权人放弃部分债权时,各担保人之间有约定的,按照约定;没有约定且互相不知道其他方存在的,各担保人之间构成不真正连带责任;当各方知道其他方存在时,他们构成连带责任。在连带责任的情形下,第三人提供的物保的价值影响各担保人之间责任的具体划分。

On matters of creditor giving up some of guarantees in mixed guarantee

Mixed guarantee has several different forms of guarantees set on the same claim.In a mixed guarantee,the division of responsibilities between guarantors is different.The debtor has the priority while the material guarantor and the credit guarantor are equal in status.The current legislation in China does not have a clear division of responsibilities in mixed guarantee,which may lead to confusion when creditor gives up some of the guarantees.So when the creditor gives up some of the guarantees,if the different guarantors have an agreement on the division of responsibilities,then stick to the agreement;If they do not have an agreement and are not aware of other guarantors＇ existence,then they take on non-real joint liability;If they are aware of others＇ existence,then they take on joint liability.On a joint liability occasion,the value of the property offered by a third person will affect the division of responsibilities between guarantors.
