公安机关延长拘留问题探析——以完善检察监督机制为视角

刑事拘留是一种限制人身自由的刑事强制措施,其运用是否正确直接关系到公民人身权利在刑事诉讼中能否得到切实的保护和尊重。我国刑事诉讼法第八十九条明确规定了公安机关刑事拘留的期限、延长期限及理由,然而在司法实践中存在公安机关滥用延长拘留等问题。检察机关有必要对公安机关延长拘留问题进行规范和监督,并完善相关检察监督机制,以实现惩罚犯罪与保障人权的效果,维护程序价值。

A Probe into Extended Detention in Public Security Organs： A Perspective of Improvement of Procuratorial Supervision Mechanism

Criminal detention is a criminal compulsory measure for restriction of personal freedom, the correct adoptation of which is directly related to effective protection and respect of the citizens personal rights in criminal proceedings. In the judicial practice, there is more or less abuse of extended detention on the part of the public security organs in deadline, extensions and reasons for extended detention, which are stipulated in China Criminal Procedure Law Article eighty-nine. Therefore, it is necessary for public security organs to standardize and supervise extended detention and improve related procuratorial supervision mechanism with a view to achieving effect of punishing crimes, protecting human rights and maintaining procedure values.
