金融附属刑事立法问题研究

在高新技术浪潮与现代化金融服务手段结合下,金融犯罪活动也日趋猖獗.我国现行刑法明显无法跟上犯罪类型更新的步伐,而金融行政立法尤其是大量的法规规章中的附属刑事责任条款的法律效力又令人质疑,因此必须厘清上述条款性质,有针对性地将之与金融刑事立法衔接,才能真正起到金融犯罪的惩戒效果.

On Financial Criminal Affiliated Legislation

With the combination of high tech and modern economic methods,the financial crime activities become more and more rampant.Not only is there void of new style of crime in Chinese criminal code,but also the validity of criminal responsibility clauses attached to administrative legislation falls into question.Therefore the author hold that the character of the clauses must be nailed down and linked up to financial criminal legislation.
