银行信用证审单标准的法哲学思考:精确性、模糊性还是原则性

The standards for examination of L/C documents consist of an accuracy standard, fuzziness standard and principle standard. The accuracy standard is represented by the mirror image theory. The fuzziness standard is represented by the substantial compliance theory. And the principle standard is represented by strict compliance theory. The principle standard provides a proper examination standard for the issuing bank. It establishes a principle of compliance of one document with others and all documents with the L/C. Also the principle standard provides much room for the issuing bank to appropriately examine L/C documents.
