“活法”与“行动中的法”——兼论民间法研究的两条路径

埃利希提出的活法概念,和庞德所提出的行动中的法,虽然是法社会学中两个相似的概念,难以区分开来,但实际上二者之间存在着某些重要的差异。通过对这二者进行比较分析,一方面可以使我们对于这两个概念得到更加清晰的认识,另一方面,可以使我们发现二者之间不同的研究路径。在我国民间法的研究领域中,仍然有一些基础性的问题还在很大程度上处于模糊状态,通过对于这两条不同研究路径的梳理,可以使我们对民间法基本范畴的研究更加清晰和自觉。

"Living Law"and "Law in Action"

the concept of living law which was introduced by Ehrlich,and the concept of law in action which was introduced by Pound are similar.But there are some important differences between them.By analyzing the differences between the two concepts,we can find the different research ways of them.These differences can help us to improve our research on folk law.
