| 摘 要： | 《刑法修正案（八）》首次从法律上明确肯定了社区矫正制度,对社区矫正服刑人员的矫正工作从此有了法律依据。目前暂予监外执行罪犯已基本纳入社区矫正,随着非监禁刑监管方式的变化,社区矫正对象重新犯罪呈现出新的特点,从社区矫正工作的角度对矫正对象重新犯罪的原因进行分析,对预防社区矫正对象重新犯罪,促进社会管理创新和社会和谐无疑具有重大意义。

| Abstract: | The Criminal Law Amendment(8) legally affirms the community correction system for the first time,ever since the community correction has the legal basis.Temporary execution outside prison offenders have basically been included in the community correction,with the changes in the way of supervision of non-custodial sentence,the community corrections object re-crime shows new feature,to analyze the causes of re-crime of the correction object from the perspective of community correction,is undoubtedly of great significance for prevention of community corrections re-crime,and promote social innovation and social harmony. |
