伪造、倒卖伪造的有价票证罪的司法认定

本罪中的“伪造”不包括变造，除非司法解释做出明确规定。本罪中的“倒卖”是指行为人明知是伪造的有价票证而低价买入、高价卖出的行为。认定“其他有价票证”的范围，应把握“有价票证”的基本特征。犯罪数额分为犯罪实行数额和犯罪结果数额，应以实行数额为定罪量刑的主要根据，同时兼顾非法获利数额。在罪数形态上，需根据不同情况确定不同类型的犯罪行为是构成本罪还是其他犯罪。该罪是行为犯，应以行为犯的既、未遂标准来认定本罪的既、未遂。
