论商业方法的专利保护

美国对State Street案的判决开启了以专利法保护商业方法的大门,日、欧等国家和地区也随之修改专利法,确认了商业方法的可专利性。我国专利法对商业方法专利的态度仍然谨慎和保守,我们应该借鉴、学习国外的经验,提高国人的专利意识、完善相关的配套措施,用积极的、开放的态度去迎接经济发展带来的机遇和挑战,制定出可行的商业方法专利制度。

Protection of Patent Law on Business Method

The judgment of State Street Case in U.S.A. is the beginning of protection of patent law by business methods.Modified patent laws,such as Japanese,European etc,has confirmed the possibility that business methods can be patented.The attitude toward the patent of business methods of China is still prudent and conservative,we should take advantage of foreign experience,improve compatriots' patent consciousness,perfect the relevant supplementary measure,meet the opportunity and challenge brought in economic development with the positive,open attitude and make the feasible business method patent law system.
