| 摘 要： | 全球化之形成得益于人性、技术、制度与政治环境等基础,当代法律发展无法摆脱全球化的语境.法律移植是后发国家学习先进法律的必经之路,而法律本土化考量的是移植来的法律如何与本土社会相结合.面对法律本土化问题,中国的立法者需要准确把握当前社会存在的问题和所移植法律在母国的产生和实施状况,并遵照法律的内在规律,制定出符合中国实际的法律,实现创造性转化.

| Abstract: | Globalization bases on human nature, technology, system and political environment which is the context of development of law. Legal transplantation is the best way to learn advanced law, and legal provincialism considers how imported law matches the local society. Legislature of China should grasp the problem of society and the situation of the imported law in its home country, then follow the inherent law of the law, enact law according to China, and at last realize the creative transformation. |
