| 摘 要： | 事实劳动关系在现实社会生活中经常发生,但法律在这方面的规定多有疏漏,对其缺乏必要的法律保护。因此,以调整保护协调劳动关系为使命的劳动法(也不排除其他的法律),不应留下这样的法律空白。所以本文从分析事实劳动关系着手,论述了事实劳动关系的实质,对其进行法律保护的理论基础与法津依据以及应如何对之保护的问题,力求在这方面作些探讨,以期对劳动立法有所裨益。

| Abstract: | The factual work relation frequently occurs in social life, but law stipulations have much omission in this aspect and lack essential legal protection to it. Therefore, the labor law that adjusts, protects and coordinates work relations have regulations about it. For this reason, this article starts with the factual work relation, elaborates its essence, discusses theory basis of carrying on legal protection and the question about how to perfect the relation for the purpose of making suggestions for work legislation. |
