| 摘 要： | 近期航运领域船舶融资租赁迅猛发展,在相关法律框架尚有待进一步完善的背景下,司法实践如何应对法律适用问题是一项重要课题。基于实证研究方法,就船舶融资租赁若干法律适用问题进行了探讨,同时对融资租赁司法解释草案也进行了适当评析。

| Abstract: | In recent years the shipping industry has experienced a dramatic increase in ship finance lease. However,the legal framework of ship finance lease is still to be perfected. In that background,when courts deal with ship finance lease cases,the application of law is an important topic. Based on the positive research method,this paper analyses several legal application problems and comments on the draft bill of judicial interpretation on finance lease contract in appropriate place through discussion. |
