宅基地上私权处分的路径设计

《物权法》对宅基地上私权流动问题未予回答，为目前法律解释和适用制造了混乱。在立法论上，应当从反思房地强制捆绑交易模式入手，重新界定房地关系，在谨慎对待宅基地使用权直接处分行为的同时，应毫无保留地支持农民对自有住宅的处分自由。按照平等、效率、自由和社会保障的要求，调谐房地异主以后权利人之间的关系，以地上权为枢纽构建允许私权处分的宅基地上权利群体系。

On Path Design for Private Disposal of Rural Residential Land
